THE RULES OF THE PRIZE WINNING GAME

Komercijalna Banka AD Skopje takes you to EURO 2008

Pursuant to the Law on Games of Chance and Entertainment Games (“Official Gazette of RM” No. 10/97, 54/97, 13/2001, 2/2002, 54/2007) and the Book of Regulations on organizing prize winning games, the following rules have been set out for the prize winning game:

Article 1
ORGANIZATION

The prize winning game “Komercijalna Banka AD Skopje takes you to EURO 2008” (hereinafter: “the Prize Winning Game”) is organized by Komercijalna Banka AD Skopje, Head Office in Skopje, Kej Dimitar Vlahov 4, 1000 Skopje, (hereinafter: the Organization).

Article 2
THE OFFICIAL NAME OF THE PRIZE WINNINGGAME

The official name of the Prize winning game is “Komercijalna Banka AD Skopje takes you to EURO 2008”.

Article 3
TERRITORY

The game is organized for individuals, owners of MasterCard or Maestro Card, issued by Komercijalna Banka AD Skopje, and shall be realized on all merchant locations, in the Republic of Macedonia and all over the world where MasterCard and Maestro payment cards are used.

Article 4
THE PRIZE WINNINGGAME DURATION

The prize winning game shall start on 01.03.2008 and last till 26.05.2008.

Article 5
INDIVIDUALS QUALIFIED TO PARTICIPATE IN
THE PRIZE WINNING GAME

All individuals (18 years old and over), citizens of the Republic of Macedonia, that are users (owners) of one of the following cards, issued by Komercijalna Banka AD Skopje, with expiry date longer than the duration of the prize winning game are qualified to participate in it:

1. Maestro debit Card 
2. MasterCard Revolving credit Card
3. MasterCard Co – branding credit Card
4. MasterCard Standard credit Card
5. MasterCard Domestic credit Card for individuals
6. MasterCard International credit card for individuals

who, on the date of taking the prize, do not have any over due amount towards the Organization arising from the usage of the above mentioned cards.

Employees in Komercijalna Banka AD Skopje (including their family: parents, children, brothers, sisters or spouses) are not qualified to participate in the game.

Article 6
MECHANISM OF RULES FOR PARTICIPATION IN THE
PRIZE WINNING GAME

Individuals from Article 5, that are qualified to participate in the game, will get one chance to participate for each 10.000,00 denars booked by the Organization, as a merchant turnover in the period from 01.03.2008 to 26.05.2008, for each product  separately.

The “merchant turnover” includes all transactions made by the cardholder and/or by users of the additional cards that are linked to the unique account, at merchant locations in the Republic of Macedonia as well as all over the world. The “merchant turnover" does not include cash withdrawals from ATMs, cash advance at banks tellers, memberships, fees and commissions and cancelled, reversals or refund  transactions.

Transactions made by users of the additional cards that are linked to the unique account of the accountholder, will be registered in favor of the accountholder, for the purposes of the game.

For each single chance, the users will receive a code written down on the monthly statements of account as well as on separate printed reports available for the users at the Bank’s counters. The codes must not be repeated.

Article 7
DRAWING

The DRAWING of prizes shall be on 29.05.2008.
All codes have equal chance in the game. The winners will be chosen automatically, by computer random choice.
The drawing of all prizes shall be public in the presence of 3 official representatives:

1. Representative from Komercijalna Banka AD Skopje
2. Representative from the Advertising Agency
3. Notary from the Republic of Macedonia

One winner and one reserve winner will be chosen for each prize. Each participant in the Game may win only one prize. If one of the winners appears more than once, the procedure will continue as long as all prizewinners are different. The prize drawing is final.
If the number of participants in the Game is smaller than the number of prizes, each participant shall win a prize in compliance with the conditions in Article 5.

 

Article 8
THE PRIZES

Here is the list of prizes included in the game:

The quantity of total prize is limited which means that the number of prizes defined previously cannot be changed. The total amount of the prize fund is 413.146,00 denars. If the Austrian Embassy refuses to give visa to the first prizewinner, his prize will be replaced by cash equivalent.

Article 9
REPOTING AND RECEIVING THE PRIZES

A list of winners shall be published within 3 working days from the prize drawing day in daily newspapers such as “Dnevnik” and “Utrinski vesnik”, as well as on the Organization’s web site www.kb.com.mk .
The winners are obliged to take prizes within a period of 60 days from the day of announcement in daily newspapers such as “Dnevnik” and “Utrinski vesnik” and on the Organization’s web site www.kb.com.mk .
The prizes can be taken every working day from 8:00 to 16:00 o’clock at the following address:

Once the winners receive the prizes, all the obligations of the Organization toward the winners will end. 

 

Article 10
QUALITY VERIFICATION AND RIGHT OF PARTICIPATION

The prize shall be given only if the participants are qualified, have the right to participate and if there is a strict observance of the Prize Winning Game rules.

Article 11
TAXES, ECHANGES, REDRAFT AND LIABILITIES

The Organization is responsible for all taxes, fees or liabilities connected to the Prize winning game, including personal tax for each prize over 10.000,00 denars.
The prizes may not be transferred or assigned prior to drawing.
After drawing of prizes, the winners will have right to assign the prize in its full value to a third person, 18 or over 18 years old, citizen of the Republic of Macedonia. The winner and the person to whom the prize is assigned are fully responsible for assigning of the prize and the problems and consequences arising there from.
The Organization does not take responsibility for any problems caused during the assigning.

Article 12
USE OF PERSONAL DATA

The Organization shall have the right to use the winner’s personal data for its future marketing activities upon previously obtained written consent by the winner.
If the winner does not agree with use of his/her personal data, he/she can send a letter to the Organization, according to which his/her personal data will be excluded from further use for such purposes.

Article 13
CANCELLATION OF THE PRIZE WINNING GAME

The Organization shall have the right to cancel the Prize Winning Game in any phase as a result of a damage caused by crime or by a force major, notifying the public through the daily newspapers.

Article 14
SETTLEMENT OF POSSIBLE DISPUTES ARISING IN CONNECTION WITH THE PRIZE WINNING GAME

Any possible disputes arisen between the Organization and the participants in the Prize Winning Game shall be settled by the competent court in Skopje.

Article 15
INFORMATION FOR PARTICIPANTS ABOUT THE PRIZE WINNING GAME RULES

The Prize winning game rules will be completely published on the Organization’s web site www.kb.com.mk  and partially published on the promotional material which will be distributed in all Branches and City Branches and in some of the points of sale where Komercijalna Banka AD Skopje has an agreement ( contract ) for accepting MasterCard and Maestro cards issued by Komercijalna Banka AD Skopje.

Article 16
PROMOTION OF THE PRIZE WINNING GAME
The promotional means used for promotion of the Prize Winning Game will be as follows:

1. Advertisements in newspapers;
2. Advertising messages on the ATM’s screens;
3. Advertising messages on the statements to the cardholders;
4. Promotional material (posters and leaflets) in all City Branches and Branches
5. Promotional material in some of the merchant locations where Komercijalna Banka AD Skopje has an agreement concluded for acceptance of MasterCard and Maestro cards.

Article 17
CLOSING REGULATIONS
(FINAL ARTICLE)

By fulfilling the rules for participation in the Prize Winning Game, the cardholders accept all the articles of these rules. These rules will be applied upon obtaining a license from the Ministry of Finance of the Republic of Macedonia and upon their publication. These rules will be valid until completion of the Prize Winning Game and until the end of the term for taking the prizes.
